The judge may impose a monetary fine of up to $1,000.00 per count plus possible jail time of up to one hundred and eighty (180) days plus a criminal record plus for CDS-Drug-Marijuana charges a driver’s license suspension of up to two (2) years.

WHAT IS MY EXPOSURE IF I AM CONVICTED OF A CRIMINAL PETTY DISORDERLY PERSONS OFFENSE?
The judge may impose a monetary fine of up to $500.00 plus possible jail time of up to thirty (30) days plus a criminal record.
DWI-DUI
N.J.S.A. 39:4-50 prohibits the operation of a motor vehicle while the driver is impaired by ingestion of alcohol and/or CDS-Drugs-Marijuana. If convicted the judge must impose the following penalties. For a first offense, a monetary fine of not less than $250.00 nor more than $500.00 plus possible jail time from zero (0) days up to thirty (30) days plus driver’s license suspension of not less than three (3) months nor more than twelve (12) months plus Intoxicated Drivers Resource Center of twelve (12) hours plus possible installation of the interlock device on your motor vehicle. For a second offense, a monetary fine of not less than $400.00 nor more than $1,000.00 plus possible jail time from two (2) days up to ninety (90) days plus driver’s license suspension of a mandatory two (2) years plus Intoxicated Drivers resource Center of not less than twenty four (24) hours nor more than forty eight (48) hours plus installation of the interlock device on your motor vehicle. For a third or subsequent offense, monetary fine of $1,000.00 plus mandatory jail time of one hundred and eighty (180) days plus driver’s license suspension of ten (10) years plus Intoxicated Drivers Resource Center of forty eight (48) hours plus installation of the interlock device on your motor vehicle. DO I NEED TO RETAIN AN ATTORNEY TO DEFEND ME IF I AM CHARGED WITH A CRIMINAL OFFENSE?
Yes. I would recommend it. It is not the amount of the fine, money is replaceable. A criminal record is an indelible mark that may take up to five (5) years to expunge. You may be precluded from securing employment as a school teacher or government official. If you are already employed by government you may be required to forfeit your position. You may be denied a license to practice by a professional licensing board even if you have met all requirements. If you are not a United States citizen you may be deported.
