WHAT CONDUCT CONSTITUTES THE OFFENSE OF DEFIANT TRESPASS?

N.J.S.A. 2C:18-3(b) Defiant Trespasser. A person commits a petty disorderly persons offense if, knowing that he is not licensed or privileged to do so, he enters or remains in any place as to which notice against trespass is given by: (1) Actual communication to the actor; or (2) Posting in a manner prescribed by law or reasonably likely to come to the intention of intruders; or (3) Fencing or other enclosure manifestly designed to exclude intruders.

(d) Defenses. (1) A structure involved in an offense under subsection (a) was abandoned; (2) The structure was at the time open to members of the public and the actor complied with all lawful conditions imposed on access to or remaining in the structure; or (3) The actor reasoanly believed that the owner of the structure, or other person empowered to license access thereto, would have licensed him to enter or remain, or, in the case of subsection (c) of this section, to peer.

Defiant trespasser charges frequently in Belmar frequently arise out of a lawful entry into a drinking establishment-bar. During the defendant’s occupation in the bar he or she is accused of engaging in offensive or illegal conduct. Bar personnel inform the defendant that he or she will no longer be served any more alcoholic beverages and that he or she must immediately vacate the premises. The defendant vacates the premises but at some point returns and attempts reentry into the drinking establishment-bar. This constitutes defiant trespasser. Oftentimes clients will reenter the bar to contact friends or family still lawfully in the bar.

WHAT IS MY EXPOSURE (PENALTIES) IF CONVICTED?

If convicted of the criminal offense of Defiant Trespasser the penalty is a monetary fine of up to $500.00 plus possible jail time of up to 30 days plus a criminal record for a petty disorderly persons offense.

DO I NEED TO RETAIN AN ATTORNEY TO DEFEND ME?

Yes. I would recommend it. Money id fungible. A criminal record is not. A criminal record can preclude one’s eligibility to obtain employment with the government, require forfeiture of one’s position if already employed by government and/or preclude one from obtaining a professional license to practice from professional licensing boards.
